Please read these Terms of Use ("Terms") carefully before using the Flock app ("App," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use this App. By using the App, you confirm that you are 18 or older. If you are under 18, please do not use the App.
2. Description of the App
Flock is a trip-planning application for groups of friends who live in different cities. The App provides:
- Group flight searches that compare prices from every participant's home airport and rank destinations by what the whole group would pay
- A shareable shortlist of destinations to send to your group chat
- Trip pages where the organiser records the chosen destination, each participant's flights and booking status
- Tools to collect accommodation options and activity ideas and to note the group's preferences
- A shared-expenses ledger that shows who paid what and who owes whom
The App is a planning tool. It does not sell flights, accommodation or any other travel service, and it does not act as a travel agent, tour operator or payment intermediary between you and any travel provider.
3. Prices and Travel Information
FLIGHT PRICES, SCHEDULES AND OTHER TRAVEL INFORMATION SHOWN IN THE APP ARE ESTIMATES PROVIDED FOR PLANNING PURPOSES ONLY.
Prices are retrieved from third-party flight data sources at the moment a search runs and may change at any time. Airlines set their own fares, availability, baggage rules and schedules. The price you see in the App is not an offer, a quotation or a guarantee of the price you will pay when booking.
Any booking is made by you directly with the airline, accommodation provider or booking website of your choice, under their terms. Always verify the final price, times and conditions on the provider's site before you pay. We are not a party to those transactions and are not responsible for them.
4. User Accounts
4.1 Registration
To use the App, you must create an account by providing an email address and a password, together with your name and home city. You agree to provide accurate, current, and complete information.
4.2 Account Security
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Please notify us immediately at support@flock-travel.app if you suspect unauthorized access to your account.
4.3 One Account Per Person
Accounts are for individual use only. You may not share your account with others or create accounts on behalf of other people without their consent.
4.4 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, provide false information, or engage in conduct that we determine to be harmful to the App or other users. You may delete your account at any time from the Profile screen in the App.
5. Information About Your Friends
To run a group search you enter the first names and departure airports of the people travelling with you. They do not need an account. By entering this information you confirm that you are entitled to share it with us for the purpose of planning the trip, and that you will not enter details about anyone who has asked you not to.
You are responsible for anything you share outside the App, such as shortlists or trip summaries sent to a messaging app.
6. Subscriptions and Payments
6.1 Subscription Model
Access to the App requires a paid subscription. Subscription pricing and billing periods are displayed at the time of purchase on the paywall screen.
6.2 Search Allowance
Each search queries live flight data, which has a cost to us. Your subscription includes a monthly allowance of group searches, shown in the App. Searches over a flexible date range or a whole month count as more than one search. Unused searches do not carry over to the next month.
6.3 Billing
All payments are processed by Apple through the App Store. You agree to Apple's payment terms. We do not store your payment card details.
6.4 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Renewal charges occur within 24 hours of the end of the current period.
6.5 Cancellation
You may cancel your subscription at any time through your Apple account settings. Cancellation takes effect at the end of the current billing period.
6.6 Restore Purchase
If you have previously subscribed, you may restore your purchase using the "Restore Purchase" option in the App. This does not create a new charge.
6.7 Price Changes
We reserve the right to change subscription prices. We will provide reasonable advance notice of any price changes. Continued use of the App after a price change takes effect constitutes your acceptance of the new price.
7. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates applicable local, national, or international laws or regulations
- Attempt to gain unauthorized access to any part of the App, its servers, or its databases
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
- Use the App to transmit any unsolicited communications, malware, or harmful code
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Use automated scripts, bots, or tools to access the App or to run searches
- Extract, scrape or resell flight price data obtained through the App
- Share, sublicense, or sell access to the App or your account
8. User Content
The App allows you to enter trip names, participant details, accommodation links, activity ideas, notes and expenses ("User Content"). You retain ownership of any User Content you create.
By entering User Content into the App, you grant us a limited, non-exclusive license to store and display that content solely for the purpose of providing the App's features to you. When you add a link to an accommodation, we fetch that page's public title and image so the App can show a preview card.
You are solely responsible for your User Content. You agree not to enter content that is unlawful, offensive, defamatory, or that infringes the rights of any third party. We do not review User Content. It is visible only to you.
9. Intellectual Property
All content in the App, including but not limited to the name "Flock", the bird mascot, designs, text, graphics, logos, icons, images, and software, is our intellectual property or is licensed to us, and is protected by copyright, trademark, and other applicable laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.
10. Disclaimers
10.1 No Guarantee of Results
We do not guarantee that the App will find a destination that suits your group, that the destinations shown are the cheapest available, or that any price shown will be available when you book. Search results depend on third-party data, on the airports and dates you enter, and on the cost limits described in Section 6.2.
10.2 Completeness of Results
A search stops once its cost limit is reached. The top-ranked destinations are verified for every participant; further destinations are shown on a best-effort basis and are marked as such in the App.
10.3 App Availability
We strive to keep the App available and functioning at all times, but we do not guarantee uninterrupted, error-free access. The App may be temporarily unavailable due to maintenance, updates, third-party data outages, or circumstances beyond our control.
10.4 Accuracy of Calculations
Totals, per-person shares, "time together" estimates and expense balances are calculated from the data you and the flight data sources provide. They are planning aids, not financial advice or binding settlements between you and your friends.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, MISSED TRAVEL, OR THE COST OF TRAVEL BOOKED ON THE BASIS OF INFORMATION SHOWN IN THE APP, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your User Content; or (d) information you enter about other people.
13. Third-Party Services
The App relies on third-party services including:
- Apple App Store, for payment processing and app distribution
- Flight data providers, which supply the prices and schedules shown in search results
- Cloud hosting and authentication providers, which store your account and trip data
- Analytics providers, for anonymized usage insights (as described in our Privacy Policy)
When you open a booking link from the App, you leave the App and enter a third-party website. We are not responsible for the practices or content of any third-party services. Your use of those services is governed by their respective terms and policies.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the App or by email. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the App and may cancel your subscription.
15. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of Luxembourg, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Luxembourg.
